Terms of Service

These Terms of Service (together with any documents or policies referenced herein, collectively the "Terms") govern your access to and use of the Fiction platform, including our website located at https://www.fiction.com (the "Site"), and all associated services, such as personal website creation tools, newsletter features, and contact/network management tools (collectively, the "Services"). These Terms are a legal agreement between you ("You" or "User") and Supereon LLC ("Fiction," "we," "us," or "our"). They do not alter any separate agreements you may have with Fiction for additional products or services.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE OR SERVICES. They include important information about your legal rights, remedies, and obligations, including a requirement to resolve most disputes through binding arbitration rather than in court, as well as limitations on liability and warranties. By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you may not use the Site or Services.

Eligibility

To use the Site and Services, you must: (1) be at least 13 years old (or the age of majority in your jurisdiction, if higher); (2) have the legal capacity to enter into this Agreement; and (3) not be prohibited from using the Services under applicable law. If you are under 18, you represent that you have parental or guardian consent to use the Services.

Your Account and Information

To access certain features of the Services (e.g., creating a personal website or sending newsletters), you may need to create an account. You agree to: (1) provide accurate, current, and complete information during registration; (2) maintain the security of your account credentials; and (3) notify us immediately of any unauthorized use of your account at hello@fiction.com. You are responsible for all activities under your account.

License to Use the Services; Intellectual Property

Subject to these Terms, Fiction grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes (e.g., building your personal brand, managing contacts, and communicating with your audience). Commercial use requires a separate agreement.

Our Content

All content provided by Fiction on the Site and Services—including templates, designs, text, software, logos, and trademarks (collectively, "Our Content")—is owned by Fiction, its affiliates, or licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of Our Content without our prior written permission.

Your Content

You retain ownership of content you create or upload to the Services, such as website text, images, or newsletter drafts ("Your Content"). By uploading Your Content, you grant Fiction a worldwide, non-exclusive, royalty-free license to host, display, and distribute it as necessary to provide the Services (e.g., displaying your website or sending your newsletters). You represent that Your Content does not infringe any third-party rights or violate applicable laws.

Subscription and Fees

Some features of the Services may require a paid subscription. Subscription terms, pricing, and payment details will be provided at the time of purchase. You agree to pay all applicable fees and taxes. Subscriptions may auto-renew unless canceled in accordance with our cancellation policy, available on the Site. We reserve the right to change pricing with notice, but changes will not affect your current billing cycle.

Prohibited Uses

You are responsible for your use of the Site and Services and must comply with all applicable laws. You may not:

• Use the Services to send spam, unsolicited promotions, or illegal content;
• Upload content that is defamatory, obscene, hateful, or violates third-party rights;
• Attempt to reverse-engineer, hack, or disrupt the Site or Services;
• Use automated tools (e.g., bots, scrapers) to extract data without permission;
• Impersonate others or misrepresent your affiliation;
• Interfere with other users’ enjoyment of the Services; or
• Use the Services for any unlawful purpose.
• We may monitor the Services for compliance and reserve the right to suspend or terminate your access if you violate these Terms, without liability to you.

Termination

You may stop using the Services at any time by discontinuing access or canceling your account/subscription via the Site. We may suspend or terminate your access if: (1) you breach these Terms; (2) we suspect fraudulent or illegal activity; or (3) we discontinue the Services (with notice where feasible). Upon termination, your license to use the Services ends, but provisions like "Limitation of Liability" and "Dispute Resolution" survive.

We comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Services infringes your copyright, you may submit a notice to our DMCA Agent:

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT: (1) THE SERVICES WILL MEET YOUR EXPECTATIONS; (2) ACCESS WILL BE UNINTERRUPTED OR ERROR-FREE; OR (3) YOUR CONTENT WILL BE SECURE FROM LOSS OR UNAUTHORIZED ACCESS. YOU USE THE SERVICES AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Fiction, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100 IF YOU USED ONLY FREE SERVICES. SOME JURISDICTIONS MAY NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Dispute Resolution by Binding Arbitration PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR RIGHTS.

Agreement to Arbitrate

You and Fiction agree that any dispute, claim, or controversy ("Claims") arising out of or relating to these Terms, the Site, or the Services will be resolved by binding arbitration, except for small claims court matters or issues you may raise with government agencies. This includes waiving your right to a jury trial or class action. The Federal Arbitration Act governs this provision.

Class Action Waiver

Claims must be brought individually, not as part of a class, collective, or representative action.

Process

Before arbitration, you must send a written notice of your Claim to legal@Fiction.com, and we’ll attempt to resolve it informally within 60 days. If unresolved, arbitration will proceed under the American Arbitration Association (AAA) Consumer Arbitration Rules (www.adr.org/consumer), conducted in [Insert City/State, e.g., New York, NY], or remotely if agreed. The arbitrator’s decision is final and binding.

Costs

We’ll cover arbitration fees if you demonstrate financial hardship, per AAA Rules. Each party bears its own attorney fees unless otherwise awarded.

Opt-Out

You may opt out of arbitration within 30 days of first using the Services by emailing legal@Fiction.com with your name and intent to opt out.

Governing Law

These Terms are governed by the laws of the State of [Insert State, e.g., New York], excluding its conflict-of-law rules, and the Federal Arbitration Act where applicable. Any non-arbitrable claims will be brought in [Insert City/State] courts.

Changes to Terms

We may update these Terms by posting a revised version on the Site, effective 14 days after posting (or immediately for legal compliance). Continued use after changes indicates your acceptance.
